Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Nebula Automate website, automation systems, and related services (“Services”). By submitting information, requesting services, approving an invoice, or submitting payment, you agree to be bound by these Terms.

Nebula Automate is an individually owned service provider operated by Chris Thomas and based in Braselton, Georgia, United States.

Scope of Services

Nebula Automate provides custom, managed AI-powered automation services for real estate professionals and teams. Services may include lead response workflows, qualification logic, messaging automation, appointment booking assistance, integrations, and system optimization.

All Services are delivered on a client-specific basis. Exact deliverables, configurations, timelines, and system behavior are defined during onboarding or documented in writing prior to work beginning.

No Guarantees or Financial Promises

Nebula Automate does not guarantee business outcomes, revenue, appointments, conversions, or sales results. Services are provided to improve operational efficiency and responsiveness only.

Results depend on factors outside Nebula Automate’s control, including lead quality, market conditions, client follow-through, and third-party platforms.

Client Responsibilities

• Providing accurate, lawful, and complete information
• Ensuring compliance with applicable laws and regulations, including TCPA, CAN-SPAM, and messaging consent rules
• Obtaining proper consent from leads prior to automated outreach
• Reviewing and approving automation behavior when requested

Billing & Payments

Nebula Automate operates on an invoice-based billing model. Services typically begin only after payment confirmation unless otherwise agreed in writing.

Onboarding, setup, and customization fees are non-refundable once work has commenced due to the upfront labor involved.

Ongoing service fees apply only if explicitly agreed to in writing. There are no free trials and no automatic renewals without notice.

Cancellations & Refunds

Clients may cancel ongoing services at any time by providing written notice.

Fees already paid for services rendered or partially completed are non-refundable. No refunds are provided for completed onboarding or setup work.

Intellectual Property

All proprietary systems, automation logic, workflows, prompts, and internal frameworks developed by Nebula Automate remain the intellectual property of Nebula Automate unless otherwise agreed in writing.

Clients are granted a limited, non-transferable right to use delivered systems during the active service period only.

Third-Party Platforms

Services may rely on third-party platforms such as CRMs, messaging providers, AI model providers, or scheduling tools. Nebula Automate is not responsible for outages, pricing changes, or policy updates imposed by third parties.

Service Availability

Services are provided on an “as available” basis. Temporary interruptions may occur due to maintenance, updates, or third-party service disruptions.

No Professional Advice

Nebula Automate does not provide legal, financial, or compliance advice. Clients are responsible for consulting their own advisors regarding regulatory and business obligations.

Limitation of Liability

To the maximum extent permitted by law, Nebula Automate shall not be liable for indirect, incidental, special, or consequential damages, including loss of revenue, data, or business opportunities.

Total liability shall not exceed the amount paid by the client for services in the thirty (30) days preceding the claim.

Governing Law

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles.

Changes to These Terms

These Terms may be updated periodically. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
